The Game is played in a web browser at trade-chronicles.com and uses a third-party backend service provider for player accounts. The Game is licensed to you for personal use; it is not sold.
1. Definitions
- Backend Service Provider: the third-party service that handles player accounts, authentication and related services for the Game, currently brainCloud, operated by bitHeads Inc.
- User Account: the account you create for the Game with your e-mail address and a password, which is held with the Backend Service Provider.
- Game: the TradeChronicles software, its servers, content, updates and any related services made available by the Operator.
- Virtual Currency: the in-Game currency that may be bought for real money and spent on in-Game items, bonuses or services.
- Privacy Notice: our notice on the processing of personal data, available at trade-chronicles.com/privacy.html.
2. Application of the Terms and amendments
By creating a User Account or using the Game you accept these ToU. If you do not accept them, you must not use the Game.
We grant you a limited, non-exclusive, non-transferable and revocable licence to use the Game for personal, non-commercial purposes, in accordance with these ToU.
We may amend these ToU with effect for the future, for example to reflect changes in the law, in the Game or in the way it is operated. We will notify you of material changes in the Game or by e-mail. If you continue to use the Game after a change has taken effect, you accept the amended ToU. If you do not agree, you may stop using the Game and close your User Account at any time.
You need a User Account to play. You are responsible for keeping your login details secret and for all activity under your User Account. Tell us without delay if you believe your account has been compromised.
3. Licence and restrictions
3.1 Licence, not sale
The Game is licensed, not sold. No ownership of the Game or any of its content is transferred to you.
3.2 Intellectual property
The Game, including its software, graphics, music, text, names and other content, is protected by copyright and other intellectual property laws. All rights not expressly granted in these ToU remain with the Operator or its licensors.
3.3 Restrictions
You must not:
- sell, rent, lease, sublicense, distribute or otherwise commercially exploit the Game or your User Account;
- copy, modify, adapt, translate or create derivative works of the Game, except as allowed by mandatory law;
- decompile, disassemble or reverse engineer the Game, except to the extent permitted by mandatory law;
- circumvent, disable or interfere with any security or access-control feature of the Game or its servers;
- remove or alter any copyright, trademark or other proprietary notice;
- use the Game for any unlawful purpose or in breach of these ToU;
- cheat, exploit bugs, use bots, scripts, macros or other automated tools that are not part of the Game, or otherwise obtain an unfair advantage or interfere with other players' use of the Game.
3.4 Permitted uses
You may create and share non-commercial fan content based on the Game, such as screenshots, gameplay videos and streams, and you may monetise such videos and streams on platforms such as YouTube or Twitch, provided that you do not suggest that the Operator sponsors or endorses your content. We may ask you to take down content that is unreasonable, for example because it is unlawful or infringes the rights of others.
3.5 Consequences of breach
A breach of these ToU may lead to civil or criminal liability. We may also warn you, restrict, suspend or terminate your User Account, and claim compensation for direct loss caused by the breach, subject to mandatory law.
4. Use of the Game
4.1 Eligibility
The Game is intended for persons aged 13 and over. If you are a minor under the law of your country, you may only use the Game with the consent of your parent or legal guardian.
4.2 Free-to-play and in-Game purchases
The Game is free to play. You may buy Virtual Currency for real money. Payments are handled by a third-party payment provider; we do not receive or store your card or bank details. Prices are shown before you confirm a purchase and include applicable taxes unless stated otherwise.
Virtual Currency can be spent only inside the Game, for example on trade automation or cosmetic items. It is a closed-loop currency: it has no real-world value, cannot be exchanged for money or anything of value outside the Game, and cannot be transferred to another person or account. By completing a purchase you ask us to deliver the Virtual Currency immediately; to the extent permitted by law, you acknowledge that your right of withdrawal ends once the Virtual Currency has been credited to your User Account. Refunds are otherwise handled in accordance with the payment provider's published refund policy and mandatory consumer law.
4.3 Player conduct
Where the Game offers communication features, such as merchant names, messages or chat, you must not post content that is unlawful, harassing, threatening, hateful, sexually explicit, infringes the rights of others, impersonates another person, is deceptive, or disrupts the Game. You must not seek an unfair advantage over other players.
4.4 Monitoring and enforcement
We may monitor use of the Game to keep it secure, to enforce these ToU and to comply with the law. You must not circumvent any access controls or restrictions we apply.
4.5 Updates
We may release updates to the Game at any time, and updates may be required to keep playing. Updates may add, change or remove features, including items that can be bought with Virtual Currency. This does not affect our obligations under mandatory law to keep the Game in conformity with the contract.
4.6 Feedback
If you send us suggestions or other feedback about the Game, you grant us a perpetual, worldwide, royalty-free licence to use it without obligation to you. You keep ownership of your feedback.
5. Disclaimers
5.1 Nature of the software
The Game is complex software and is played online. Bugs, interruptions and errors can occur. The Game is regarded as defective only if its usability is severely affected for a prolonged period.

These ToU apply from the moment you first accept them and for as long as you use the Game.

7.3 Effect of termination
On termination your right to use the Game ends immediately. Rights that have accrued before termination, and provisions that by their nature should survive it, remain in force.
7.4 Discontinuation
We may discontinue the Game, individual worlds or features. We will give reasonable advance notice in the Game or by e-mail, so that you can use any remaining Virtual Currency before the Game or feature is shut down.
